1. Agreement and eligibility

These Terms form an agreement between the customer accepting them and the legal operator of Accordelle. The person accepting must be at least 18 and authorized to bind the customer. Accounts may be used only for lawful HOA or community-association operations.

2. The service

Accordelle collects architectural requests and files, checks configured completeness requirements, extracts review facts, compares submissions with customer-provided governing documents, and prepares review materials. Features may change as the service improves.

3. Human decision requirement

Accordelle provides administrative and decision-support tools. It does not approve or deny requests, practice law, determine legal rights, or replace an authorized board, committee, manager, attorney, accessibility review, or fair-housing process. The customer must verify source documents, citations, extracted facts, deadlines, and every final decision.

4. Customer responsibilities

The customer must have authority to upload personal information and governing documents; provide accurate configuration and billing information; manage user roles; protect sign-in access; obtain required notices and consents; follow fair-housing, accessibility, records, privacy, and association laws; and promptly report suspected unauthorized access.

5. Acceptable use

Users may not misuse the service, upload unlawful or malicious material, attempt unauthorized access, interfere with security, reverse engineer except where law permits, use outputs as an automatic legal or eligibility decision, discriminate unlawfully, or use the service to make decisions outside authorized association business.

6. Customer content

Customers retain ownership of their content and grant Accordelle a limited license to host, process, reproduce, transmit, and display it only to provide, secure, support, and improve the contracted service. Customers are responsible for content legality, accuracy, retention instructions, and permissions.

7. Plans, billing, and taxes

Monthly plans renew automatically until cancelled. Lifetime plans are a one-time license for the purchased plan, subject to these Terms, reasonable-use limits, and service continuity; they do not promise every future premium product. Prices exclude applicable taxes. Stripe processes payments. The Refund and Cancellation Policy is incorporated into these Terms.

8. Suspension and termination

Accordelle may suspend access for nonpayment, security risk, unlawful use, material breach, or risk to other customers. Either party may terminate as allowed by the purchased plan and law. On termination, access ends and customer data is handled under the Privacy Policy and applicable data-processing terms.

9. Confidentiality and security

Each party will protect the other party’s nonpublic confidential information using reasonable care and use it only for the agreement. No internet service is perfectly secure; customers should not upload information unnecessary for the workflow.

10. Disclaimers

The service is provided “as is” and “as available” to the extent permitted by law. Accordelle does not warrant uninterrupted operation, error-free extraction, legal compliance of a customer’s documents or decisions, or that generated findings are complete or correct.

11. Liability

To the extent permitted by law, neither party is liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages. Accordelle’s aggregate liability will not exceed the fees paid by the customer during the 12 months before the event giving rise to the claim. This limitation does not apply where prohibited by law.

12. Indemnity

The customer will defend and indemnify the operator against third-party claims arising from customer content, unlawful use, unauthorized decisions, or violation of law or third-party rights, subject to prompt notice and reasonable cooperation.

13. Governing law, venue, and changes

These Terms are governed by Arizona law, without regard to conflict-of-law rules. Any permitted court proceeding must be brought in a state or federal court with jurisdiction in Arizona, and each party consents to that forum. Material changes will be announced in advance when required. Continued use after an effective update constitutes acceptance where permitted.
